2. Account Registration
To use certain features of our Services, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information and to update it as necessary.
3. Description of Services
OpenLine provides AI-powered call answering, call routing, appointment scheduling, lead qualification, and related communication services for businesses. Our AI receptionist answers phone calls on your behalf, interacts with callers, and performs actions based on your configured preferences.
4. Acceptable Use
You agree not to use the Services to:
- Violate any applicable laws or regulations
- Send unsolicited or unauthorized communications (spam)
- Transmit harmful, fraudulent, or deceptive content
- Interfere with or disrupt the Services or servers
- Attempt to gain unauthorized access to our systems
- Use the Services for any illegal, harassing, or abusive purpose
- Violate the rights of any third party
5. Telephony and SMS Services
Our Services utilize telephony infrastructure provided by third-party providers, including Twilio, to handle voice calls and SMS messaging. By using our Services, you agree to comply with all applicable telecommunications laws and regulations, including but not limited to:
- The Telephone Consumer Protection Act (TCPA)
- The CAN-SPAM Act
- FCC regulations governing automated calls and text messages
- State and local telecommunications laws
You are responsible for obtaining all necessary consents from individuals before our Services contact them on your behalf. You agree not to use our Services to send unsolicited text messages or make unsolicited automated calls.
SMS consent and opt-out
If you enable SMS notifications for yourself or your callers, you confirm that appropriate consent has been obtained. All SMS recipients may opt out at any time by replying STOP. We honor all opt-out requests immediately.
6. Call Recording
Our Services may include call recording and transcription features. You are solely responsible for complying with all applicable call recording laws, including one-party and two-party consent requirements in your jurisdiction. You agree to configure appropriate caller notifications as required by law.
7. Payment and Billing
Certain features of the Services require a paid subscription. By subscribing, you agree to pay all applicable fees as described in your selected plan. Fees are billed in advance on a monthly or annual basis. All payments are non-refundable except as required by law or as otherwise stated in these Terms.
We reserve the right to change pricing with 30 days' notice. Continued use of the Services after a pricing change constitutes acceptance of the new pricing.
8. Intellectual Property
The Services, including all software, content, trademarks, and intellectual property, are owned by OpenLine or our licensors. You are granted a limited, non-exclusive, non-transferable license to use the Services in accordance with these Terms. You may not copy, modify, distribute, or reverse engineer any part of the Services.

Our AI is designed to handle calls professionally, but we do not guarantee specific outcomes from any call interaction.
11. Limitation of Liability
To the maximum extent permitted by law, OpenLine shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Services. Our total liability shall not exceed the fees paid by you in the twelve (12) months preceding the claim.
12. Indemnification
You agree to indemnify and hold harmless OpenLine and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Services, your violation of these Terms, or your violation of any applicable law or regulation.
13. Termination
Either party may terminate these Terms at any time. You may cancel your account through your account settings or by contacting us. We may suspend or terminate your access to the Services if you violate these Terms or if we determine, in our sole discretion, that your use poses a risk to us or other users.
14. Modifications
We may update these Terms from time to time. We will notify you of material changes by email or through the Services. Your continued use of the Services after changes are posted constitutes your acceptance of the updated Terms.
15. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts located in Delaware.
